Terms & Conditions

Please read the terms and conditions relevant to the service you are booking. These terms help us keep appointments, classes and memberships fair, safe and clear for all clients.

Physiotherapy and Clinical Exercise Terms and Conditions

1. General

By booking or attending an appointment with Cadence Physical Therapy Pty Ltd, you agree to these Terms and Conditions.

Our physiotherapists are registered with the Australian Health Practitioner Regulation Agency and Physiotherapy Board of Australia to provide services in accordance with Australian professional standards.

2. Appointments

Appointments may be booked online, by phone, email, or in person.

We will make reasonable efforts to provide services at your scheduled appointment time. Occasionally, appointments may need to be changed, delayed, or rescheduled due to practitioner illness, clinical priority, emergency, safety issue, staffing issue, or operational disruption. If this occurs, we will notify you as soon as reasonably practicable and offer you the next suitable appointment. You will not be charged a cancellation fee if Cadence reschedules your appointment and the alternative time offered is unsuitable.

3a. Cancellation and Non-Attendance Policy - Physiotherapy consultations

We require at least 24 hours’ notice to cancel or reschedule physiotherapy appointments.

If less than 24 hours’ notice is provided, Cadence may charge a late cancellation fee of up to the full consultation fee.

If you do not attend an appointment and do not notify us, the full consultation fee may be charged.

Cadence may waive or reduce a cancellation fee in exceptional circumstances, including sudden illness, emergency, or circumstances outside your reasonable control.

Cancellation and non-attendance fees are the responsibility of the patient and cannot be claimed through Medicare, private health insurance, workers compensation schemes, motor vehicle accident insurers, NDIS, or other third-party funders unless that funder expressly agrees in writing.

3b. Cancellation and Non-Attendance Policy - ‘Cadence Refine’ - Clinical Exercise Classes

We require at least 12 hours’ notice for cancellations or rescheduling of Cadence Refine Classes.

Cadence Refine Classes cancelled with less than 12 hours’ notice may incur a cancellation fee. We allow clients up to 2 ‘grace’ late cancellations, as we understand that circumstances can change without prior notice at times. From the 3rd cancellation a $20 late cancel fee will apply per late cancellation.

If you do not attend a class and do not notify us, the full class fee may be charged.

Cancellation and non-attendance fees are the responsibility of the patient and cannot be claimed through Medicare, private health insurance, workers compensation schemes, motor vehicle accident insurers, NDIS, or other third-party funders unless that funder expressly agrees in writing.

4. Late Arrivals

If you arrive late, your consultation may need to be shortened to avoid impacting other patients.

If you arrive too late for treatment to proceed safely or effectively, the appointment may be considered a non-attendance.

5. Fees and Payment

Full payment is required at the time of consultation.

We accept payment via EFTPOS, credit card, cash, and approved third-party funding arrangements.

If a third-party payment does not occur for any reason, you will be responsible for payment of the debt. This includes the inability to produce a valid private health care card at your appointment. You will be required to make payment in full for the appointment and we will provide you with a tax invoice for you to claim directly from your private health fund.

Outstanding accounts may result in suspension of future bookings.

6. Consent to Treatment

By attending your appointment, you agree to participate in physiotherapy assessment and, where clinically appropriate, treatment provided by our practitioners.

Your physiotherapist will explain the nature, purpose, expected benefits, material risks, and available alternatives of proposed treatment where relevant to your care.

Treatment may include manual therapy, exercise programs, rehabilitation programs, dry needling, taping, electrotherapy, education, and advice.

You acknowledge that treatment outcomes cannot be guaranteed and that some treatments may cause temporary discomfort, soreness, or symptom change.

You may ask questions at any time and may refuse or withdraw consent to any part of your assessment or treatment at any time.

7. Medical Information

You agree to provide accurate and complete health information relevant to your treatment.

You must inform your physiotherapist of:

  • Injuries
  • Medical conditions
  • Pregnancy
  • Medications
  • Changes in symptoms

Failure to provide accurate information may affect treatment safety and outcomes.

8. Privacy and Clinical Records

Cadence collects, uses, stores, and discloses personal and health information in accordance with our Privacy Policy and applicable privacy laws. This may include information required to provide treatment, manage bookings and payments, communicate with you, liaise with referrers or third-party funders where authorised, and maintain clinical records.

Cadence maintains clinical records relating to your care. Records are managed in accordance with applicable privacy, health record, and professional obligations.

9. Minors

Patients under 18 years of age must have appropriate consent from a parent or legal guardian before treatment.

Cadence may request written consent and may require a parent or guardian to attend appointments where clinically, legally, or operationally appropriate.

Cadence may refuse or discontinue treatment for a minor where appropriate consent is not provided or where the practitioner considers that treatment should not proceed without a parent or guardian present.

10. Emergency and Urgent Medical Care

Cadence does not provide emergency medical services. If you are experiencing a medical emergency, severe or worsening symptoms, chest pain, shortness of breath, signs of stroke, loss of consciousness, serious injury, or any other urgent medical concern, call 000 or attend the nearest emergency department.

Your physiotherapist may recommend referral to a GP, specialist, emergency department, or other healthcare provider where clinically appropriate.

11. Refusal or Discontinuation of Service

We reserve the right to refuse or discontinue treatment where:

  • Treatment is clinically inappropriate
  • A patient behaves aggressively or inappropriately
  • Safety concerns arise
  • Fees remain unpaid
12. Communications

We may contact you by phone, SMS, email, or other electronic means about appointments, treatment-related matters, accounts, service updates, and administrative matters. You are responsible for ensuring your contact details are accurate and up to date.

13. Liability

To the extent permitted by law, Cadence Physical Therapy Pty Ltd is not liable for indirect or consequential loss arising from the use of our services.

Nothing in these Terms excludes rights under the Australian Consumer Law or other applicable laws.

14. Changes to Terms

These Terms and Conditions may be updated from time to time. The latest version will be available on our website and/or in clinic.

Pilates Terms and Conditions

Waiver

I, the undersigned, agree to follow the safety instructions of my instructor and to inform them immediately should I have any pain or concerns during Pilates. I agree that I do not have any injuries, chronic pain problems or physical ailments which would prevent me from undertaking Pilates in a class environment and that I take Cadence Pilates classes at my own risk.

I understand that a workout may be physically strenuous and I voluntarily participate in them with full knowledge that there is a risk of personal injury, property loss or death. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Cadence Physio & Pilates or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

I give authority to Cadence Physio & Pilates to take my photo/filmed image and give permission for it to be used on social media for promotional purposes, edited, copied or distributed (individuals under 18 years require permission by a parent/guardian). I understand that it is my responsibility not to participate in photos or filmed images if I do not consent to having my image used.

I understand that customers are required to give 9 hours notice of change or cancellation of booked sessions. No refund will be issued for missed classes that have been booked in advance.

By booking into a class you automatically agree to the above terms and conditions.

Obligations of Membership

Update your contact details should they change so we can keep contact with you as necessary

Contact us if your student status changes

Pay all agreed fees

Inform us in advance if there are any risks to your general health and if required seek approval from your physiotherapist or general practitioner.

Termination of Membership

All Cadence Physio & Pilates memberships are no lock in contract after the minimum spend equal to the cost of 12 weeks of the membership

Cancel anytime via the Cadence Physio & Pilates app or website.

Suspension Policy

Members are entitled to freeze (suspend) their membership for a minimum of two weeks and maximum of 6 months.

Member to complete membership freeze form

The membership will automatically recommence after the freeze period has been completed and debit fees will be adjusted as applicable.

Membership freezes cannot be backdated.

All classes booked during the frozen period will be automatically canceled when freeze is actioned.

Members that want to freeze their membership for longer than six months will need to cancel their membership and recommence on new membership when they decide to return. Please note that the Foundation membership will not be available for re-purchase if the membership has been cancelled.

Cadence Individual

30 min personal training session of reformer/pilates equipment with Cadence Physio & Pilates Instructor

Not eligible for private health rebates (if you have a clinical issue or concern please book an appointment with one of our Physiotherapist for assessment to determine eligibility into our Cadence Refine stream).

$75 per individual session (casual pass)

$110 per double session (2 people)

Block Pass options include: 5 for $320 with expiry of 6 months, 10 for $620 with expiry of 12 months.

Bookings & Attendance

BOOKINGS

Classes and Individual Sessions are on a first come first served basis. Classes and Individual Sessions can be booked up to 4 weeks in advance.

Bookings can be made via the Cadence Physio & Pilates app or website.

WAITLIST

If a class you want to attend is fully booked please sign up for the waiting list. Should a spot become available and you are the first person on the waitlist, you will automatically move into the class and will receive a SMS notification to let you know you’re booked into the class. You won’t be required to confirm the booking, just turn up to class and enjoy your Pilates workout!

1 hour before the class start time the waitlist will change to ‘Fastest Finger First’ - when a spot in the class becomes available, an SMS will be sent to everyone who is on the waitlist. The first person to respond to the SMS accepting their spot will be booked into the class.

Cancellation Policy

At Cadence Pilates our class sizes are small. We value each and every member and as such hope to be able to have availability as open as possible. For group classes cancellations need to be made 9 hours prior. Late cancellations and/or no shows will incur a lost class credit (for block pass, active memberships) or a ‘Late Cancel Fee’ of $10 will be charged (for Foundation and All Access memberships).

For Intro Sessions cancellations need to be made 9 hours prior. Late cancellations and/or no shows will incur a $10 reactivation fee.

Instructors and classes are subject to change without notice. Cadence Physio & Pilates reserves the right to cancel classes if necessary.

1. Access

All new clients must attend an intro session before attending classes.

Intro Session:

Intro session is a 1:1 with a Cadence Physio & Pilates instructor providing a health and fitness screen and introduction to the Pilates reformer.

I understand that if I don’t book this class I will be turned away from attending any classes until I have attended my 1:1 Intro Session.

2. Use of Equipment & Safety

For the safety of you and others, please follow all equipment operating and safety instructions on the equipment. If you are unfamiliar with equipment or are not sure as to the correct use please ask for assistance from one of the Cadence Pilates Instructors.

For safety and hygiene reason grab socks must be worn to classes. Grip socks are available for purchase in the studio. If you don’t have grip socks you can be turned away from attending the class.

The warm up is a critical part of the Cadence Pilates class. For your own safety and out of consideration of the Instructor and others in the class, should you be more than 5 minutes late for the class you may not be able to join the class.

The Instructor or treating physiotherapist reserve the right to restrict members to a particular class for safety reasons.

We do not offer creche facilities in our studios. Children are not permitted in the studio at anytime and are not to be left in the reception area while you attend classes. You may be turned away from the studio should you arrive with your children. This is for the safety of your own children and other clients attending the studio.

3. Pregnancy

If you are pregnant you must inform your Instructor and we can assist you to modify the exercises for your safety and appropriate to your stage in pregnancy.

You must attend a 1:1 Physiotherapy assessment at 12 weeks to go through exercise modifications, alternatives and recommendations.

Written medical clearance from obstetrician/GP/midwife in charge of prenatal care clearing you for exercise after 12 weeks is required.

If remaining in general Cadence Pilates classes after 12 weeks, Physiotherapy assessments will need to occur at 20, 30 & 35 weeks to monitor class appropriateness, technique and safety.

A post natal assessment and medical clearance to return to exercise is required before returning to classes after having your baby.

Our standard physiotherapy consult fees apply for 1:1 Physiotherapy sessions.

4. Osteoporosis

If you have been diagnosed with low bone density (osteoporosis or osteopenia) you are required to indicate this by answering the bone density question at checkout.

A 1:1 Physio consult is strongly recommended before commencing group reformer classes at Cadence Physio & Pilates to go through exercise modifications, alternatives and recommendations

Education about Pilates and low bone density will also be provided in the Physio consult

4. Payments by Credit Card and Direct Debit

Credit card and Direct Debit payments will be debited from Momence utilising a third party payment system - Stripe. The following transaction fees apply from 1st April 2025:

2.75% + A$0.30 for online credit card payments

2% + A$0.30 for BECS (direct debit)
